1. Who these terms apply to
These terms apply to your use of chat.v1stax.com, the V1stax hosted instance operated by ferocity. If you run your own self-hosted V1stax instance, these terms do not apply to your instance — you are responsible for setting your own terms with your users.
By creating an account or using the service, you agree to these terms.
2. Eligibility
You must be at least 13 years old to use V1stax. If you are under 18, you should have permission from a parent or guardian.
You must not use the service if you are prohibited from doing so under applicable law.
3. Your account
You are responsible for keeping your account credentials secure. Do not share your password. Notify us immediately if you believe your account has been compromised.
Each person may maintain one account. Creating multiple accounts to evade a ban or suspension is not allowed.
4. Acceptable use
You may use V1stax for any lawful purpose. The following are not allowed:
- Posting content that is illegal under applicable law
- Child sexual abuse material (CSAM) or any sexual content involving minors — zero tolerance, no exceptions. Any discovered CSAM will be reported to the National Center for Missing & Exploited Children (NCMEC) CyberTipline as required by 18 U.S.C. § 2258A, and the account will be terminated immediately.
- Harassment, threats, or targeted abuse of other users
- Spam — unsolicited bulk messages, invite flooding, or coordinated manipulation
- Impersonating other people or organizations in a deceptive way
- Attempting to compromise the security or availability of the service
- Using the service to distribute malware or phishing content
Node owners are responsible for the content and conduct within their Nodes. We may remove content or terminate accounts that violate these terms.
5. Content ownership
You own the content you post on V1stax. By posting it, you grant V1stax a limited license to store and transmit that content for the purpose of operating the service. We do not claim ownership of your content and we do not use it to train AI models.
When you delete a message or account, your content is removed from our systems. Copies may persist briefly in backups until they are rotated out (maximum 7 days).
6. Termination
We reserve the right to suspend or terminate accounts that violate these terms, at our discretion. For clear violations (CSAM, credible threats, active attacks on the service) we will act immediately without prior notice. For lesser violations we will generally warn first.
You can delete your account at any time from the app settings.
7. Alpha service — no uptime guarantee
V1stax is currently in alpha. The service is provided as-is. We make no guarantees about uptime, data retention, or continued availability. We will make reasonable efforts to keep the service running and to notify users of planned downtime, but this is a one-person indie project — things break sometimes.
8. Limitation of liability
To the maximum extent permitted by law, V1stax is provided without warranty of any kind. We are not liable for indirect, incidental, or consequential damages arising from your use of the service.
9. Changes to these terms
We may update these terms from time to time. Material changes will be announced in the V1stax announcements channel and noted on this page. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
10. Copyright (DMCA)
V1stax respects intellectual property rights. If you believe content on this service infringes your copyright, submit a takedown notice to our designated agent:

A valid notice must include: (1) identification of the copyrighted work claimed to be infringed; (2) identification of the infringing material and its location on our service; (3) your name, address, and contact information; (4) a statement of good faith belief that the use is not authorized by the copyright owner; (5) a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner; (6) your physical or electronic signature.
We will respond to valid notices promptly and remove or disable access to infringing content. Repeat infringers will have their accounts terminated.
11. Governing law
These terms are governed by the laws of the State of Hawaii, without regard to conflict of law principles. Any disputes arising under or related to these terms will be subject to the exclusive jurisdiction of the state and federal courts located in Hawaii.
